The Culture Curator Speak Up Platform
- The Connection Coach and The Culture Curator
The Culture Curator is a division of The Connection Coach Pty Ltd (ABN 16 614 983 023), a registered Australian company providing professional services in human resources, leadership development, and workplace wellbeing. All contractual agreements, invoicing, and legal obligations entered into under The Culture Curator brand are fulfilled by The Connection Coach as the legal entity. References to “The Culture Curator” throughout these Terms and Conditions should be interpreted as services delivered by The Connection Coach under its trading division.
2. Purpose of the Platform
The Speak Up platform is a confidential and secure tool provided by The Culture Curator to support a psychologically safe workplace. It enables individuals to report workplace concerns or misconduct, share feedback, and recognise positive contributions anonymously or confidentially.
Reports may relate to, but are not limited to:
- Bullying, harassment or discrimination
- Misuse of power or authority
- Work health and safety breaches
- Fraud, corruption or unethical behaviour
- Conflicts of interest
- Policy violations or misconduct
- Positive feedback, innovation or staff recognition
3. Scope of Use
This platform is intended for use by employees, contractors, and relevant stakeholders of client organisations engaged with The Culture Curator. Use of the platform must be made in good faith and in accordance with these Terms and Conditions.
4. Confidentiality and Anonymity
You may choose to submit a report:
- Anonymously: Without disclosing your identity.
- Confidentially: Your identity is known to The Culture Curator but not disclosed to the client organisation without your consent.
All reports will be managed with strict confidentiality and in accordance with applicable privacy and whistleblower protection laws.
5. Indemnity and Limitation of Liability
The Culture Curator, acting as an independent third-party facilitator of the Speak Up whistleblower platform, is not responsible for the actions taken—or not taken—by the Client organisation in response to reports submitted via the platform. The Culture Curator does not guarantee the resolution of any report, nor does it provide legal, disciplinary, or operational advice to either the reporter or the employer beyond the scope of agreed services.
To the maximum extent permitted by law, the Client agrees to indemnify and hold harmless The Culture Curator (a division of The Connection Coach, ABN 16 614 983 023), its officers, employees, contractors, and affiliates from and against all claims, demands, losses, liabilities, damages, or expenses (including legal costs) arising out of or in connection with:
- Any decision made by the Client in response to a report submitted through the Speak Up platform
- Any employee action or complaint arising from the use of the platform
- The misuse of the platform or breach of these Terms by the Client or its representatives
The Culture Curator’s total liability, whether in contract, tort or otherwise, is limited to the total fees paid by the Client for the whistleblower platform access and support services in the 12-month period preceding the claim.
6. Management of Reports
All reports submitted via the Speak Up platform are received and triaged by The Culture Curator, who acts as an independent third-party provider. Where appropriate, reports will be:
- Acknowledged and reviewed
- Investigated independently or escalated to the client organisation
- Handled in line with relevant legislation and internal company policies
The Culture Curator may liaise with the whistleblower to gather more information or provide updates via the secure platform messaging system.
7. False or Misleading Reports
Reports must be made honestly and with reasonable belief in the information provided. Deliberately false, vexatious, or malicious reports may result in investigation and may carry consequences under the relevant workplace policies or applicable laws.
8. Whistleblower Protections
Your rights are protected under the Corporations Act 2001 (Cth) and other applicable Australian whistleblower laws. Protections include:
- Protection of identity
- Protection from detriment or retaliation
- Civil, criminal, and administrative immunity for eligible disclosures

9. Use of the Platform
Users agree:
- Not to misuse or tamper with the platform or systems
- Not to breach the privacy or confidentiality of any party involved in a report
- Not to use the system for personal grievances better addressed through internal HR processes
HR-related grievances such as performance reviews or interpersonal disputes should first be raised through internal HR channels unless they meet the criteria for a whistleblower report.
10. Fees and Payment Terms
Fees for Speak Up platform access are determined by the subscription tier and number of users. Payment is required upfront unless otherwise agreed. Ongoing access is contingent on timely payment of renewal fees.
All pricing is exclusive of GST unless otherwise stated. Cancellation or change in subscription tier must be made in writing with [30] days’ notice prior to renewal.
11. Data Security and Hosting
The Speak Up platform is hosted by WhistleblowerSoftware.com, which complies with GDPR and ISO/IEC 27001 standards for data protection. Data is stored securely, and access is restricted to authorised personnel only.
12. Limitation of Liability
The Culture Curator is not liable for any action taken or not taken by the client organisation in response to a report. Our role is to receive, triage, and escalate concerns in line with our services agreement and ethical obligations.
13. Amendments
These terms may be updated from time to time. Users are encouraged to review them periodically. Continued use of the platform constitutes acceptance of any changes.
